For lenders in Ohio, they can use the judicial foreclosure process when foreclosing any mortgage in default.
Judicial Foreclosure
The court decides on giving the borrower a specific time at which the borrower should settle his debts. Once the debts are paid, the borrower still has the right over the property. If unable to settle his debt, the clerk of the court then decides on selling the property.
It is important to note that prior the date of foreclosure, the three disinterested parties must be involved in the appraisal of the said property. The appraisal is fled to the clerk of court. As a requirement, the property should be sold at least 2/3 of the value.
As a requirement, the notice of sale must be published. The county newspaper must have the notice of sale printed once for three consecutive weeks.
The sheriff is the one who is in charge of the auction. He will lead the auction which is held at the courthouse and given to the highest bidder.
The borrowers have redemption rights before any of the foreclosure sale is confirmed by court. He must settle the debts that he owes the lender in order to gain ownership to the property. The lenders can also file for deficiency judgement for the property.
